The ThirdAge Privacy Policy

1. General
ThirdAge Inc. (hereinafter "ThirdAge") respects the privacy of every individual who visits www.thirdage.com (hereinafter the "Web Site"). This Privacy Policy outlines the information ThirdAge will collect and how we will use that information. This Policy will also instruct you on what to do if you do not want your personal information collected or shared.

2. Personally-Identifiable Information
There are cases where ThirdAge may ask you for personally-identifiable information such as your name, mailing address and e-mail address. For example, we request personally-identifiable information when you register for an account on the Web Site, for online shopping or transactions, or for other services that require registration or subscription. ThirdAge will not collect any personally-identifiable information about you unless you provide it to us voluntarily.

When you do provide us with personally-identifiable information, ThirdAge may:

  • Store and process that information to better understand your needs and how we can improve our products and services;
  • Use that information to contact you for informational, marketing and promotional purposes;
  • Disclose that information to third parties when we have reason to believe that disclosing the information is necessary to identify, contact or bring legal action against someone who may be causing injury to or interference with the rights or property (either intentionally or unintentionally) of ThirdAge, other members or users of the Web Site, or anyone else that could be harmed by such activities;
  • Disclose that information to third parties when we believe in good faith that the law requires it;
  • Disclose that information to third parties when we believe in good faith that such action is necessary to enforce the Terms of Service; and
  • Disclose that information when we contract with a third party to deliver e-mail on our behalf or provide other services involving list update or list maintenance.

Except as stated in this Privacy Policy, or as otherwise stated at the time personally-identifiable information is gathered, we will not provide personally-identifiable information to third parties, although certain non-personally-identifiable user information may be provided in aggregate form to third parties.

In case you would like to remove or change some personally-identifiable information, you may do so by visiting your member account page or contacting ThirdAge Support. (Remember, however, that removing some or all of your personally-identifiable information may limit your ability to access some or all of the features and services of the Web Site.) In addition, to keep you in control of your personally-identifiable information and the communications directed to you, we allow you to opt-out of receiving communications from ThirdAge about new Web Site features or ThirdAge services. You may opt-out of these services by managing your Newsletter subscriptions or contacting ThirdAge Support.

Some of our services or promotions are offered through an affiliation with another company in what we call a "co-branded" area of our site or through a co-sponsored promotion, and visitor information may be shared with those partners and/or sponsors. If you request information about or from our partners or sponsors, or visit a co-branded or sponsor-specific area of the site, you give ThirdAge permission to provide information about you (such as your e-mail address) to the partner or sponsor.

3. Public Forums
This Web Site may make discussion boards, groups and/or other public forums available to its users. Please remember that any information that is disclosed to these areas becomes public information and you should exercise caution when deciding to disclose your personal information.

4. Children
This Web Site is not directed at individuals under 18 years of age, and ThirdAge does not intend to collect any personally-identifiable information from such individuals. Where appropriate, ThirdAge will specifically instruct children not to submit such information on the Web Site. If a child has provided us with personally-identifiable information, a parent or guardian of that child should contact us at the mailing address or e-mail address listed at the bottom of this Policy if he would like this information deleted from our records. We will use reasonable efforts to delete the child's information from our existing files.

5. Non-Personally-Identifiable Information

ThirdAge may also collect information about you that is not personally-identifiable. Examples of this type of information may include your age, gender, interests and preferences, the type of Internet browser you are using, the type of computer operating system you are using, and the domain name of the web site from which you linked to the Web Site. ThirdAge may share this information with advertisers, business partners, sponsors and other third parties. For example, ThirdAge may inform a sponsor that the membership of the Web Site is x percent females and y percent males. This data is used to customize the Web Site's content and advertising, and to deliver a better experience for our members and users.

6. Information We May Place Automatically on Your Computer's Hard Drive

When you view the Web Site, we may store some information on your computer. This information will be in the form of a "Cookie" or similar file and will help us in many ways. A Cookie is an element of data that a web site can send to your browser, which may then store the Cookie on your hard drive. Consequently, the next time you visit the Web Site, ThirdAge can recognize you. For example, Cookies are used to allow us to track clickstream data and tailor the Web Site to better match your interests and preferences. The Web Site allows links to various other web sites as stated in ThirdAge's Terms of Service. ThirdAge assumes no responsibility for the information practices of sites you are able to access through the Web Site. These links to other sites do not imply affiliation or endorsement of a linked site in any way.

8. Security
Please keep in mind that whenever you give out personal information online -- for example, discussion boards or groups -- that information can be collected and used by people you don't know. While ThirdAge strives to protect your information and privacy, we cannot guarantee the security of any information you disclose online and you do so at your own risk.

The importance of security for all personally-identifiable information associated with our users and members is of utmost concern to us. Unfortunately, no data transmission over the Internet can be guaranteed to be secure. As a result, while we strive to protect your personally-identifiable information, ThirdAge can't ensure or warrant the security of any information you transmit to us or from our online products or services, and you do so at your own risk. Once we receive your personally-identifiable information, we will take reasonable efforts to ensure its security on our systems.

Your account on the Web Site is password-protected so that only you can access it and view the member information relevant to the account. We recommend that you do not divulge your password to anyone. ThirdAge will never ask you for your password in an unsolicited phone call or e-mail. Ultimately, you are responsible for maintaining the secrecy of your passwords and any account information. Remember to sign out of your account on the Web Site and close your browser window when you have finished your work. This is to ensure that others cannot access your personal information and correspondence if your computer is accessible to others or if you share a computer with someone else or are using a computer in a public place like a library or an Internet café. 9. Business Transfers
As we continue to develop our business, we might sell or buy stores or assets, or transfer a service we provide to a carefully chosen strategic partner. In such transactions, customer information is generally one of the transferred business assets.

10. Your Acceptance of These Terms
By using the Web Site, you signify your assent to the ThirdAge Privacy Policy and the Web Site's Terms of Service. If you do not agree to this Policy or the Terms of Service, please do not use the Web Site. Your continued use of the Web Site following the posting of changes to these terms will mean you accept those changes.
